1. Acceptance of Terms

By accessing and using the Mander Wines website (manderwines.com), you agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable Canadian federal and provincial laws. If you do not agree with any part of these terms, you must not use this website.

2. Age Requirement

You must be at least 19 years of age (the legal drinking age in Ontario) to access this website, purchase products, or subscribe to our communications. By entering this site and confirming your age, you represent and warrant that you are of legal drinking age in your province or territory of residence. Misrepresentation of your age is a violation of these terms and may constitute an offence under applicable law.

3. Products and Availability

• All wines offered by Mander Wines are produced and sold in accordance with the regulations of the Alcohol and Gaming Commission of Ontario (AGCO) and the Liquor Licence and Control Act, 2019 (Ontario).
• Product availability is limited and subject to change without notice. Our wines are produced in small lots; once a vintage is sold out, it may not be restocked.
• We reserve the right to limit quantities, refuse orders, or cancel transactions at our discretion.
• Product descriptions, tasting notes, and images are provided for informational purposes and may vary slightly from the actual product.

4. Allocation List and Waitlist

Joining our allocation or waitlist does not guarantee the purchase of any product. Allocation is offered on a first-come, first-served basis, subject to availability. We reserve the right to modify, suspend, or discontinue the allocation program at any time.

5. Pricing and Payment

• All prices are listed in Canadian dollars (CAD) and are inclusive of applicable taxes unless otherwise stated.
• Prices are subject to change without prior notice.
• Payment must be made in full at the time of purchase through our accepted payment methods.
• We are not responsible for pricing errors. In the event of an error, we will notify you and offer the option to proceed at the correct price or cancel your order.

6. Shipping and Delivery

• Wine shipments are made in accordance with Ontario and Canadian regulations governing the sale and transport of alcoholic beverages.
• An adult (19+) with valid identification must be present to receive all deliveries containing alcohol. No deliveries will be left unattended.
• Shipping is available only to jurisdictions where we are legally permitted to deliver. We currently ship within Ontario, Canada.
• Mander Wines is not responsible for delays caused by carriers, weather, or other circumstances beyond our control.
• Risk of loss transfers to you upon delivery to the carrier.

7. Returns and Refunds

• Due to the nature of alcoholic beverages and regulatory requirements, all sales are final. We do not accept returns or offer refunds except in cases of damaged or defective products.
• If you receive a damaged or defective product, please contact us at info@manderwines.com within 48 hours of delivery with a description and photo of the issue. We will arrange a replacement or refund at our discretion.

8. Intellectual Property

All content on this website — including text, images, logos, graphics, the Mander name and monogram, and design elements — is the property of Mander Wines and is protected under Canadian copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

9. User Conduct

You agree not to:

• Use this website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the website or its systems
• Transmit viruses, malware, or any harmful code
• Scrape, harvest, or collect data from the website without permission
• Misrepresent your identity or age

11. Limitation of Liability

To the maximum extent permitted by applicable law, Mander Wines, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or the purchase of our products. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Mander Wines, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of this website, your violation of these terms, or your violation of any third-party rights.

13. Responsible Consumption

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the website after changes are posted constitutes your acceptance of the revised terms.
